1. Acceptance of Terms
The customer acknowledges having read these general terms and conditions of sale at the time of placing the order and expressly declares to accept them without reservation. These conditions govern the contractual relations between the company EMPIRE and its client. These general terms and conditions of sale shall prevail over any other conditions appearing in any other document, except in the event of a prior, express, and written waiver.
2. Products
The photographs illustrating the products are provided for guidance only and are intended to be as accurate as possible. However, they cannot ensure a perfect similarity with the product offered, particularly regarding colors, which may vary depending on the settings of the screens used. The liability of the company EMPIRE cannot be engaged in the event of minor differences. All products offered to its customers by the company EMPIRE are available in our warehouse. If a product offered on the site should exceptionally be out of stock, we will contact you as soon as possible to inform you, propose a new delivery time, or offer an equivalent replacement product. You will also have the option to request the cancellation and full refund of your order.
3. Orders
Automatic recording systems are considered proof of the nature, content, and date of the order. The company EMPIRE confirms the acceptance of the order to the customer at the e-mail address provided by the latter. The sale will only be concluded upon confirmation of the order. The company EMPIRE reserves the right to cancel or refuse any order from a customer with whom there is a dispute relating to the payment of a previous order. The information provided by the buyer when placing the order is binding upon them: in the event of an error in the wording of the recipient's contact details, the seller cannot be held responsible for the impossibility of delivering the product.
4. Delivery and Transfer of Risks
Following order confirmation, the company EMPIRE undertakes to ship the references ordered by the buyer. Delivery will be carried out by La Poste (Colissimo), Mondial Relay, Chronopost, or FedEx depending on the customer's choice. In accordance with legal provisions, delivery will take place within the timeframe indicated when ordering and, failing an indication, at the latest within 30 days following the conclusion of the contract. In the event of a delivery delay, the customer has the option to cancel their order under the conditions provided for in Article L. 216-6 of the French Consumer Code.
Transfer of risks: In accordance with Article L. 216-4 of the French Consumer Code, any risk of loss or damage to the goods is transferred to the customer at the moment when the latter, or a third party designated by them (other than the carrier proposed by EMPIRE), physically takes possession of these goods.
Receipt of the package: IIt is the customer's responsibility to check the condition of the package upon arrival. In the event of damage or missing items, the customer is invited to make precise reservations on the delivery note. In accordance with Article L. 224-65 of the French Consumer Code, if the carrier does not give the customer the opportunity to effectively check the good condition of the goods, the customer has a period of 10 days to notify the carrier of their reservations by registered letter.
Customs and taxes: For deliveries outside the European Union, the customer undertakes to pay all taxes due upon the importation of products, customs duties, and other taxes due under the laws of the country of receipt. The company EMPIRE declines all responsibility if the payment of taxes is not carried out by the customer. Orders are intended for the personal use of customers; any partial or total resale is prohibited.
For availability reasons, an order may be delivered to the customer in multiple shipments, while only paying for a single delivery. If the customer wishes to have two separate delivery locations, they must place two orders with the associated delivery fees. The following are considered cases of force majeure releasing the seller from its obligation to deliver: exceptional weather conditions, war, riots, fire, strikes, and the impossibility of being supplied.
5. Withdrawal and Exchange
5.1. Withdrawal Periods
In accordance with current legislation, you have a period of 14 calendar days from the receipt of your items to exercise your right of withdrawal without having to justify reasons or pay penalties. The calculation starts the day after the delivery of the goods. If this period expires on a Saturday, Sunday, or public holiday, it is extended until the first following working day. To exercise this right, we invite you to use our dedicated Returns Portal - Only for countries in the European Economic Community. Empire reserves the right to establish the terms and conditions for returning orders from countries outside the EEC
5.2. Exceptions and Conditions
The right of withdrawal does not apply to the following purchases:
- Goods made to your specifications or clearly personalized (e.g., skateboards gripped upon request).
- Goods unsealed by the customer after delivery and which cannot be returned for reasons of hygiene or health protection (e.g., underwear, socks whose protective packaging has been removed).
- Goods inseparable from other items after delivery.
Condition of returned products: Products must be returned in a condition allowing them to be re-marketed as new. Trying on clothing and shoes is permitted. However, the consumer's liability may be engaged in the event of depreciation of goods resulting from manipulations other than those necessary to establish the nature, characteristics, and proper functioning of these goods. Customers are requested to leave tags attached when trying items on. Accessories, shoes, and other technical products must be returned in their original box (which must not be used as a shipping carton) and with their manuals.
Refund and Exchange: In the event of withdrawal, the company EMPIRE will refund all sums paid, including standard delivery costs (the cheapest delivery method proposed to the customer; delivery costs for more expensive services will not be refunded), without undue delay and at the latest within 14 days following the date of recovery of the goods. Return shipping costs remain the responsibility of the customer. In the event of an exchange, the company EMPIRE offers the return shipping costs for the new item for mainland France (limited to one exchange per order). If the value of the replacement item is different, the difference will be billed or refunded to the customer.
6. Pricing
Prices are expressed in euros. The price indicated on product sheets does not include transportation costs. The price indicated in the order confirmation is the final price, expressed all taxes included (TTC), including VAT for France and European Union countries. This price includes the price of the products, handling, packaging, and transportation costs. Please note that customers located outside the EU may be subject to customs duties or additional taxes. These fees are borne by the customer, fall under their sole responsibility, and cannot be used as a reason for returning or refusing delivery of orders.
7. Payments
The price of the products is payable in full on the day the order is effectively placed. Payment is made:
- Online, by bank card, via a secure banking server.
- Via PayPal. The order validated by the customer will only be considered effective when the banking payment centers have given their agreement. In the event of refusal, the order will be automatically cancelled.
8. Legal Warranties
The company EMPIRE is bound by conformity defects of the goods to the contract under the conditions of Article L. 217-3 and following of the French Consumer Code, and by hidden defects of the sold item under the conditions provided for in Articles 1641 and following of the French Civil Code.
Legal guarantee of conformity: The customer benefits from a period of two (2) years from the delivery of the goods to take action. They can choose between the repair or replacement of the good, subject to the cost conditions provided for by Article L. 217-12 of the French Consumer Code. They are exempt from providing proof of the existence of the lack of conformity during the twenty-four (24) months following the delivery of the new good. This guarantee applies independently of any commercial guarantee possibly granted by the manufacturer.
Guarantee against hidden defects: The customer may decide to implement the guarantee against hidden defects of the sold item within the meaning of Article 1641 of the French Civil Code. In this hypothesis, they can choose between the cancellation of the sale or a reduction of the sale price in accordance with Article 1644 of the French Civil Code.

The company EMPIRE collects personal data necessary for processing orders, invoicing, and the proper management of the commercial relationship. In accordance with the General Data Protection Regulation (GDPR) and the modified Data Protection Act (Loi Informatique et Libertés), you have a right of access, rectification, erasure, limitation of processing, portability, and opposition regarding your personal data. You can exercise these rights by contacting us via our contact form or by mail to the registered office address. The company EMPIRE undertakes not to resell, free of charge or for consideration, the contact details of its customers to third parties for commercial prospecting purposes.
10.Disputes, Mediation, and Applicable Law
These general terms and conditions are subject to French law. In the event of a dispute, the customer shall first contact the customer service of the company EMPIRE to seek an amicable solution.
Consumer mediation: In accordance with Articles L.616-1 and R.616-1 of the French Consumer Code, we offer a consumer mediation scheme. If you wish to know the mediation entity selected, please contact us.
Failing an amicable agreement or solution via mediation, French courts shall have sole jurisdiction. The consumer may bring a case, at their option, before the court of the place where they resided at the time of the conclusion of the contract, or that of the place of actual delivery of the good, in addition to the courts territorially competent under the French Code of Civil Procedure.
